Welcome to Nesta Sites (“we,” “us,” “our”). By accessing or using our website (nestasites.com) and services (collectively, the “Services”), you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, please do not use our Services.


1. Services Overview

Nesta Sites provides website creation, hosting, and maintenance designed for small businesses. Our goal is to offer an affordable, hassle-free solution to establish and maintain a professional online presence.


2. Eligibility

By using our Services, you represent and warrant that you:

  • Are at least 18 years old.
  • Have the authority to enter into these Terms on behalf of yourself or your business.
  • Will provide accurate and complete information during sign-up.

3. Payment Terms & Subscriptions

Subscription Structure: Our websites are offered on a fixed monthly subscription basis, with no upfront cost. Pricing remains consistent for the duration of your subscription. You are not locked into a long-term contract — you can cancel at any time.

Billing & Renewal: Subscriptions are billed monthly and renew automatically unless canceled before the next billing cycle. Charges will continue until cancellation is requested.

Refund Policy: Payments are non-refundable, except under our Risk-Free Guarantee (see Section 8).

Payment Methods: We accept major credit cards and may offer other payment methods as needed. By subscribing, you authorize us to charge your payment method on a recurring basis.

Failed Payments: If a payment attempt fails, we’ll notify you. Access to your website may be paused if billing remains unresolved after multiple attempts. See Section 13 for more details on account suspension.


4. What’s Included in Your Plan

Your subscription includes:
Professional Website Design – A fully built website tailored to your business.
Premium Hosting – Fast, secure, and reliable website hosting.
Performance & Security Updates – We ensure your website is always running smoothly.
Technical Support – We handle any performance or technical issues on your site.

Design or content change requests outside the original scope are available through upgrade packs and add-ons.


5. Website Ownership & Transfer Policy

You own full rights to use the website while subscribed to our service.

  • If you wish to transfer your website to another provider, a one-time transfer fee applies — equivalent to 12 months of service or the remainder of your current term (whichever is lower).
  • Once the transfer fee is paid, your website is fully yours and may be transferred at any time.

Please note:

  • Your website may include premium plugins that are licensed under Nesta’s subscription. If transferred, these plugins will no longer be licensed under our plan and may require separate purchase.
  • Once transferred, Nesta is no longer responsible for the website’s performance, updates, or compatibility with your new provider.

6. Cancellations & Website Access

You can cancel your subscription at any time.

  • Your website will be taken offline at the end of your billing cycle unless a transfer is requested.
  • To retain your website, you must pay the applicable transfer fee.

Cancellation Examples:

  • Cancel after 4 months → No further charges, but the website is removed.
  • Cancel after 7 months and want to keep the website → Pay 5 more months to reach 12 (or remaining term).
  • Cancel after 12 months → Website is fully owned and can be transferred freely.

7. Technical Support & Upgrade Services

Included Support:
For all plans, we handle technical issues, security updates, and performance monitoring as part of your subscription.

Unlimited Support (Pro Plan+ only):
If you’re subscribed to the Pro Plan+ or higher, “unlimited support” also includes:

  • Text and Image Updates: We’ll make updates or replacements to text and images on your existing pages.
  • Technical Assistance: Troubleshooting and ongoing support to ensure your site runs optimally.
  • General Maintenance: Regular updates to plugins, themes, and backend systems for security and performance.

Unlimited support applies only to the existing pages and structure of your site. Requests for new pages, added content, or structural changes can be handled through a paid upgrade pack.

Not Included As “Support”:

  • Website redesigns, new features, or content creation outside your current plan — available through support packs or custom upgrades.

8. Risk-Free Website Preview (Pro Plan + Only)

We want you to feel confident moving forward — that’s why the Pro Plan+ includes a risk-free preview.

After you sign up, we’ll begin drafting your website and share an early preview before anything goes live. This is your opportunity to review the direction, request changes, and make sure it aligns with your expectations.

If, during this early stage, you feel the project isn’t the right fit, you can cancel and request a full refund. This guarantee applies only during the initial concept and draft phase — not after extended revisions or once substantial work has been completed.

Once your website is in its final stages or goes live, the project is considered active, and the guarantee no longer applies.


9. Requirements of the Client

Once you select and purchase your website subscription, you will receive access to our onboarding form. You are required to:

  • Submit your company’s information in full.
  • Upload all media (images, logos, videos) in one complete submission.
  • Avoid sending content in multiple stages — we require all assets up front to begin work.
  • We will not begin the project until the onboarding form and complete media set are submitted.

Delays in providing this information will delay the start of your project.


10. Client Understanding

You understand and acknowledge that a website alone does not guarantee online traffic or lead generation.

  • In order to drive traffic and results, marketing efforts must be made beyond the website.
  • These can include (but are not limited to): Google Ads, Facebook Ads, SEO, Google Business listings, social media, print materials, and other outreach campaigns.
  • If you need help in this area, we’re happy to offer advice or recommend trusted service providers.

11. Client Responsibility for Final Approval

It is your responsibility to review and approve the website’s content and copy before launch.

  • We are not liable for incorrect information, typos, or outdated content that was not corrected or flagged by you during the review process.
  • By giving approval or proceeding to launch, you confirm that all provided information is accurate and has been reviewed.

12. Displaying Our Work

We’re proud of what we build and may display your website in our portfolio, social channels, and other promotional material.

  • We reserve the right to showcase any designs, screenshots, or in-progress work related to your project.
  • Unless otherwise requested, we will include a small footer credit such as “Website by Nesta Sites.” or similar.
  • If you would like to remove this credit, a $250 one-time fee applies.
  • Removing the credit does not remove our right to design credit or to showcase the project.

13. Non-Payment & Account Suspension

  • 30 Days Past Due: Website suspended. (Temporarily taken offline)
  • 60 Days Past Due: Account terminated and website may be permanently deleted.

14. Limitation of Liability & Disclaimer of Damages

We do our best to provide reliable, high-quality service — but like any digital service, we can’t guarantee perfection.

By using our Services, you agree that:

  • We are not responsible for any indirect, incidental, special, consequential, or punitive damages — including loss of revenue, business, data, or profits — even if we were advised those damages could happen.
  • We’re not liable for issues caused by third-party platforms, hosting providers, or plugin conflicts.
  • Our total liability under these Terms will not exceed the amount you’ve paid us in the past 12 months.

It’s also your responsibility to back up your own content, confirm the accuracy of your website before launch, and follow applicable laws related to your business.


15. Right to Refuse Service

We reserve the right to refuse or discontinue service to any client at our discretion. This may apply in situations where:

  • The project falls outside the scope of our services,
  • The client engages in disrespectful behavior, unreasonable demands, or excessive revision requests,
  • We determine that the working relationship is no longer a good fit for either party.

If service is refused and no substantial work has been completed, a full refund may be issued. However, if we have already invested significant time — including but not limited to revisions, meetings, strategy work, or content integration — we reserve the right to retain part or all of the payment to cover work completed.

Please note: engaging us in ongoing revisions, submitting multiple change requests, or approving early drafts constitutes meaningful project engagement. Once this level of work has begun, the project is no longer eligible for a full refund under our Risk-Free Website Preview.


16. Changes to These Terms

We may update these Terms periodically. Updates will be posted on this page, and continued use of our Services after changes constitutes acceptance of the revised Terms.
