Welcome to Nesta Sites (“we,” “us,” “our”). By accessing or using our website (nestasites.com) and services (collectively, the “Services”), you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, please do not use our Services.

1. Services Overview

Nesta Sites provides website creation, hosting, and maintenance designed for small businesses. Our goal is to offer an affordable, hassle-free solution to establish and maintain a professional online presence.

2. Eligibility

By using our Services, you represent and warrant that you:

  • Are at least 18 years old.
  • Have the authority to enter into these Terms on behalf of yourself or your business.
  • Will provide accurate and complete information during sign-up.

3. Payment Terms & Subscriptions

  • Subscription Fees: Our Services are offered on a subscription basis starting at $59/month, unless otherwise specified.
  • Billing & Renewal: Subscriptions automatically renew each month unless canceled before the next billing cycle.
  • Refund Policy: Payments are non-refundable.
  • Payment Methods: We accept major credit cards and other specified payment methods.

4. What’s Included in Your Plan

Your subscription includes:
✔ Professional Website Design – A fully built website tailored to your business.
✔ Premium Hosting – Fast, secure, and reliable website hosting.
✔ Performance & Security Updates – We ensure your website is always running smoothly.
✔ Technical Support – We handle any performance or technical issues on your site.

Design or content change requests are available through support packs and add-ons.

5. Website Ownership & Transfer Policy

  • You own full rights to use the website while subscribed to our service.
  • If you wish to transfer your website to another provider, there is a one-time transfer fee equivalent to 12 months of service ($708) or the remainder of your current term (whichever is lower).
  • Once the transfer fee is paid, we will package your website files and provide everything needed for migration.

6. Cancellations & Website Access

  • You can cancel at any time without penalty, but your website will be taken offline at the end of your billing cycle.
  • If you want to retain your website after canceling, you must pay the one-time transfer fee equivalent to 12 months of service or your remaining term.
  • Once the 12-month mark is reached, your website is fully yours, and you can transfer it at any time without a fee.

Cancellation Examples

Cancel Anytime, No Obligation – You cancel after 4 months → No further charges, but the website is removed.
Transfer & Keep Your Site – You cancel after 7 months but want to keep the website → Pay 5 more months to reach 12.
After 12 Months – You cancel after 14 months → Your website is fully owned and can be transferred freely.

  • Please note: Your website is built using premium plugins that are covered under Nesta’s subscription. If you choose to transfer your website to another provider, these premium plugins will no longer be licensed under our plan and may be deactivated. You may need to purchase your own licenses to continue using them.
  • Additionally, once your website is transferred, Nesta is no longer responsible for its functionality, maintenance, or compatibility with other hosting providers or platforms. Any setup, troubleshooting, or technical support after the transfer will be your responsibility or that of your new provider.

7. Technical Support & Upgrade Services

Included Support:

  • We handle any technical issues, security updates, and performance optimizations as part of your plan.

Not Included in Basic Plan:

  • Website redesigns, new features, or content updates – Available through support ticketing or upgrade packs.

If you need design updates, additional pages, or marketing enhancements, these services can be purchased separately.

8. Non-Payment & Account Suspension

  • 30 Days Past Due: Your website will be suspended (temporarily taken offline).
  • 60 Days Past Due: Your account will be terminated, and your website may be permanently deleted.

9. Limitation of Liability

We provide our Services as is and make no guarantees about specific results, website traffic, or lead generation. We are not liable for any loss of business, revenue, or damages related to the use or inability to use our Services.

10. Changes to These Terms

We may update these Terms periodically. Updates will be posted on this page, and continued use of our Services after changes constitutes acceptance of the revised Terms.
